Welcome to Marta McCue Fine Jewelry. These Terms of Service ("Terms") govern your access to and use of our website, our products, and our bespoke commission services (together, the "Services"), operated by [Legal entity name, e.g. Marta McCue Fine Jewelry LLC] ("we," "us," or "our").

By accessing this website, placing an order, or commissioning a piece, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to make a purchase or commission a piece. By using the Services you represent that you meet this requirement and that the information you provide is accurate and complete.

2. The Services

Marta McCue Fine Jewelry designs and creates hand-made, made-to-order fine jewelry, including bespoke commissions and limited collections. Certain pieces are offered for sale directly through this website; others, including high jewelry, are available by private enquiry only. We reserve the right to accept or decline any order or commission request at our sole discretion.

3. Orders & Acceptance

Your submission of an order or a commission deposit constitutes an offer to purchase. No order is binding on us until we confirm acceptance in writing and, where applicable, receive your deposit. We may decline or cancel an order — including after a confirmation has been sent — in cases including suspected fraud, pricing or description error, gemstone or material unavailability, or inability to verify payment, in which case any amounts paid for that order will be refunded.

4. Bespoke Commissions

All made-to-order and bespoke commissions are governed by our Bespoke Commission, Returns & Shipping Policy, which is incorporated into these Terms by reference. That policy sets out the design and rendering approval process, deposits, the point at which production begins, and our all-sales-final terms once production has commenced. By commissioning a piece you confirm you have read and agree to that policy.

5. Pricing & Payment

All prices are listed in USD and are subject to change without notice. We make every effort to display accurate pricing, but errors may occur; where a piece is listed at an incorrect price, we reserve the right to cancel the order and refund any payment, whether or not the order has been confirmed.

Fine jewelry prices may reflect prevailing precious metal and gemstone markets at the time of order. Quoted commission prices are valid for 30 days unless otherwise stated. Payment must be received in full per the terms of your order or commission before a piece is shipped.

6. The Nature of Handmade Fine Jewelry

Our pieces are made by hand from natural and laboratory-grown materials. As such:

• Natural gemstones contain inclusions, color variations, and characteristics inherent to genuine stones; these are not defects but marks of authenticity.
• Minor variations between the final piece and renderings, photographs, or prior examples are an expected feature of hand craftsmanship and do not constitute a defect.
• Colors displayed on your screen may differ from the finished piece due to monitor and lighting variation.
• Gemstone weights and measurements are approximate and within standard industry tolerances unless a certified report (e.g. IGI, GIA) is provided, in which case that report governs.

Where a piece is accompanied by an independent grading report, that report is the authoritative description of the stone.

7. Intellectual Property

All content on this website — including designs, renderings, photographs, text, the house logo, and the overall look and feel — is owned by or licensed to Marta McCue Fine Jewelry and is protected by copyright, trademark, patent, and other intellectual property laws.

Pearfinity® is a registered trademark. Échange™ is a trademark, and the Échange™ interchangeable gemstone system is protected by patent. Our designs, including the structural and ornamental elements of our pieces, are our exclusive intellectual property.

You may not reproduce, copy, manufacture, distribute, or create derivative works from any of our designs, marks, or content without our prior written consent. Purchase of a piece conveys ownership of that physical piece only and grants no license or right in the underlying design, marks, or intellectual property. Unauthorized reproduction of our designs or use of our marks will be pursued to the fullest extent of the law.

8. Acceptable Use

You agree not to use the Services to: violate any law; infringe our or any third party's intellectual property; transmit malicious code; scrape, harvest, or copy content for commercial purposes; impersonate any person; or interfere with the security or operation of the website. We may suspend or terminate access for any breach of these Terms.

9. Shipping, Title & International Orders

Shipping, insurance, transfer of title and risk, and responsibility for international duties and taxes are governed by our Bespoke Commission, Returns & Shipping Policy. In summary, pieces are shipped fully insured, title and risk pass on delivery, and for international orders you are the importer of record and solely responsible for all duties, customs charges, and taxes imposed by the destination country.

10. Care & Warranty

Fine jewelry requires proper care. We provide care guidance with each piece, and following it is a condition of any remedy we offer. Our sole obligations regarding defects and remedies are as set out in our Bespoke Commission, Returns & Shipping Policy. Except as expressly stated there, the Services and all products are provided "as is," and we disclaim all other warranties, express or implied, including any implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law. Damage arising from ordinary wear, accident, loss, theft, improper care, or work performed by any jeweler other than our atelier is excluded.

11. Limitation of Liability

To the fullest extent permitted by law, Marta McCue Fine Jewelry and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Services or any product. Our total aggregate liability for any claim arising out of or relating to the Services or a product shall not exceed the amount you actually paid to us for the piece or order giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability; in such cases the limitations apply to the maximum extent permitted.

12. Indemnification

You agree to indemnify and hold harmless Marta McCue Fine Jewelry and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Pam Beach County or Broward County, FL and you consent to the jurisdiction of those courts. 

14. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

15. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this website with a new "Last updated" date. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms. The Terms in effect at the time you place an order govern that order.

16. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Bespoke Commission, Returns & Shipping Policy and Privacy Policy, constitute the entire agreement between you and us regarding the Services and supersede any prior understanding.
